Terms Of Service

1. Service Description

MaxAura AI ("the Service") provides AI-powered personal styling analysis including face shape detection, seasonal color analysis, hairstyle recommendations, and eyewear suggestions. The Service is operated by MaxAura AI, operated by Shirish Kadam.

2. AI Accuracy Disclaimer

All recommendations generated by MaxAura AI are produced by artificial intelligence and are intended for guidance and entertainment purposes only. They do not constitute professional styling, medical, dermatological, or clinical advice. Results may vary based on photo quality and individual features. MaxAura AI makes no guarantees about the accuracy or suitability of AI-generated recommendations.

3. Free Tier

The free plan is a one-time allowance for new accounts: 1 AI analysis (one photo upload) and 3 virtual try-ons. Free allowances do not reset monthly. MaxAura AI reserves the right to adjust free tier limits at any time with reasonable notice.

4. Pro Subscription & Payments

MaxAura Pro is a paid subscription offering unlimited analyses and additional features, subject to the fair use policy in Section 12. How billing works depends on where you subscribed.

4a. Subscriptions bought on the website

• Stripe, Inc. acts as our Merchant of Record through its Link service. Stripe handles checkout, payment processing, billing, indirect tax calculation and remittance (in 80+ countries), fraud prevention, and dispute management.
• Your purchase appears on your bank or card statement as LINK.COM* MAXAURALAB.COM. The transaction is facilitated by Link, a Stripe service, on behalf of MaxAura AI.
• Billing occurs monthly or annually, based on the plan selected at checkout.
• Subscriptions auto-renew unless cancelled before the next renewal date.
• You may cancel at any time; access continues through the end of the paid billing period.
• Refunds, chargebacks, and payment disputes are handled by Stripe under their policies and applicable law. Refund requests can be submitted via [email protected] or directly through Stripe's consumer terms.
• For the purposes of payment and tax compliance, your purchase contract is with Stripe, Inc. (operating as "Sold through Link"), not with MaxAura AI. MaxAura AI retains responsibility for product delivery and customer support.

4b. Subscriptions bought in the iOS app

Purchases made inside the MaxAura iOS app are auto-renewing subscriptions sold by Apple, not by us. The following terms apply:

• MaxAura and MaxAura Pro are offered as weekly, monthly, and yearly auto-renewing subscriptions. The price for your country is shown in the app before you confirm, and each period grants the try-on allowance and features described for that tier.
• Payment is charged to your Apple Account when you confirm the purchase.
• Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends, at the price of the plan you chose.
• You can manage your subscription and turn off auto-renew in your Apple Account settings after purchase. We cannot cancel or refund an App Store subscription on your behalf.
• Cancelling stops the next renewal; the current paid period is not refunded and continues until it expires.
• A discounted introductory offer, where shown, applies only to the first billing period and only if you are eligible under Apple's rules. It renews at the standard price afterwards. Eligibility is determined by Apple, not by us.
• Refunds for App Store purchases are handled solely by Apple under the Apple Media Services Terms. Request one at reportaproblem.apple.com.
• One MaxAura account holds one active subscription at a time. Subscribing on the App Store while a website subscription is active — or the reverse — may result in paying twice, since the two are billed by different companies. Cancel the first before starting the second.

5. Acceptable Use

You agree not to:

• Use the Service if you are under 16 years of age
• Upload photos of minors without parental consent
• Upload offensive, harmful, or illegal content
• Submit sensitive personal information that is not necessary for styling analysis
• Attempt to reverse-engineer, scrape, or abuse the Service
• Share your account credentials with others
• Use automated tools to abuse the free tier
• Use the Service in a way that violates applicable third-party provider terms or law

6. Intellectual Property

The MaxAura AI brand, design, and software are owned by MaxAura AI, operated by Shirish Kadam. AI-generated analysis results are provided for your personal use. You may share results for personal, non-commercial purposes with attribution to MaxAura AI.

7. Limitation Of Liability

MaxAura AI, operated by Shirish Kadam, is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service. The Service is provided "as is" without warranties of any kind.

8. Changes To Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated via the app or email.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Valencia, Spain.

10. Dispute Resolution

Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. Please contact us at [email protected] with a description of your concern. We will respond within 14 business days. If no resolution is reached within 30 days of the initial contact, either party may pursue available legal remedies.

11. Fair Use Policy

MaxAura Pro plans are described as "unlimited" in reference to the absence of per-session caps and the ability to analyse as many photos as you like. To protect service availability and ensure a consistent experience for all users, a monthly fair-use limit applies to virtual try-ons (AI-generated outfit, hairstyle, and eyewear images):

• MaxAura Pro: 300 virtual try-ons per calendar month. This limit resets on the first day of each calendar month. It is designed solely to prevent automated or non-human use and is not expected to be reached under any normal individual usage pattern.
• If you reach this limit, you will receive an in-app notification. Try-ons resume automatically on the first day of the following month.
• If you have a legitimate need exceeding this limit, contact us at [email protected] — we will accommodate reasonable requests on a case-by-case basis.

Automated scripts, bots, or any non-human usage of the virtual try-on features are prohibited under Section 5 (Acceptable Use) regardless of subscription tier.
